There are a load of people involved, and if EA buy the license that doesn't secure them Vigil as I understand it. Thus Vigil could get good terms. While EA may not support such games too well (and lots of people unreasonably seem to have an issue with them), they have put some good support in their partners program.
Squares in, the bidding WB also. And Acti.
Personally I would hope Square finds enough for Sleepy Dogs and WB picks up Darksiders and Saints… possibly Dawn of War to them too.
Metro? Could see with EA or Square.

Things are looking rather... Interesting.
Scattered reports are saying that companies such as Nintendo and Double Fine are eyeing certain IPs that are available, and many people are saying that SEGA now owns the Company of Heroes franchise while Deep Silver/Koch Media are the current highest bidders for Volition (please no).

It's all happenin'.
