Agreed. Companies shouldn't be allowed to brick the product that you bought, but if you sign a contract that gives the company the right to do so, that's on you.

You should obviously steal one so as to avoid creating a contract with Nintendo so you can pirate your 3DS games. Duh.*

Nope, it doesn't quite work like that. At least in Sweden, there are some basic consumer rights a company has to give you, and that's something that can never be taken away using contracts or anything else. For example, if you're not buying an item in a store, you're entitled to return it within 14 days. You're also protected against manufacturer defects within 3 years. These are just two examples of nonnegotiable rights that consumers have by law. I think intentionally destroying something you bought because they feel it is in their best interest, should be prohibited by the same standard.

I'm pretty certain they'll have had their legal team look into what they can and can't do, and no disrespect, but I'm betting that a lawyer for Nintendo might know a little bit more about the law surrounding this than you do...

I hate when companies brick their products for things like this, but you can't really blame them if it's PIRACY.

Though, on an unrelated note, I think it's bullshit that Apple provides a very limited ability to customize the interface of their products, and they go and brick the ones that are trying to be different.... Though that is very off topic.

Seb, I understand how you feel that they shouldn't intrude on your belongings... but you're pretty much stealing from them. They should have some form of defense against that, and they make you agree to it. So yeah. You're fucked six ways from Sunday.

"By using this device, you agree to the enclosed Terms of Use. If you do not agree with the Terms of Use, then you should return your product for a full refund".
ToU will need to have something explicit in it that says if you're using non-legitimate software, or circumventing the copy protection on either the device itself, or the game media, then Nintendo would be able to remotely brick the device.

I believe there's been a few cases of people trying to argue that because they didn't read the T&Cs that they couldn't be legally bound by them. The problem is that by using whatever device, and NOT returning it to the vendor, then they are in fact agreeing to be bound by the T&Cs.

Doesn't really work either. The market needs regulations. If I didn't buy a product because the company behind it does some stuff I don't agree with, I wouldn't buy any product from any company.. They're all a shady bunch.

Also, I won't buy it for a while, either.. I decided it's not worth it considering the launch games. Once it gets a decent library I'll buy it. Or perhaps I'm all PC gaming now o:
